The BVI Beacon: "Citing “extraordinary circumstances” and Evroy Barth’s remorse over confronting another man with a loaded gun in 2009, Justice Rita Joseph-Olivetti let the 24-year-old avoid prison with a suspended sentence Friday. He could have faced life imprisonment.
A High Court jury found Mr. Barth, a member of the CB4Lyfe rap group, guilty on Oct. 29 of aggravated burglary, possession of a firearm with intent to put in fear, possession of ammunition with intent to endanger life, and possession of explosives.
The charges stemmed from a Feb. 29, 2009 incident in which Mr. Barth confronted Andre Gaymes with a 0.25 calibre firearm at Mr. Gaymes’ Long Bay apartment. Mr. Gaymes, a disc jockey known as “DJ Dre,” was a friend of Jody Miller, who is the mother of Mr. Barth’s child. The two had become intimate, but professed all along to be “just friends,” according to Stephen Daniels, Mr. Barth’s attorney."
